These terms constitute a legal document ("the Agreement"), which sets out the rights and obligations of you as a purchaser ("you"), and those of Duck's Back Ltd("we" or "us"), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for these services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.

You agree to: provide true, accurate, current and complete information about yourself as prompted by our registration form (such information being the "Registration Data"); and maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Pure Experience has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Pure Experience has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Pure Experience site (or any portion of it).

Data Protection: Pure Experience complies with each of the eight principles of the Data Protection Act 1998. Those principles require that data is:

fairly and lawfully processed
processed for limited purposes
adequate, relevant and not excessive
accurate
not kept longer than necessary
processed in accordance with the data subject's rights
secure
not transferred outside the EU without adequate protection

Pure Experience is a trading style of Duck's Back Ltd,a company registered in England. Unless otherwise specified, the materials on this site are directed solely at those who access this site from the United Kingdom mainland. adultadventures makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement. You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.

If any provision of this Agreement shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

The information provided by Pure Experience on each experience is correct at the time of print. However, the content or format of experiences may change slightly during the year. Details of each experience are available on our website or by calling Pure Experience on 0870 0663583 and are included in the gift pack. Your participation is conditional on your acceptance of the adultadventure description detailed in the booking process.

The images used in all promotional literature to illustrate experiences, particularly those that take place at more than one location, are used as an indication only. Each venue varies.

The Pure Experience network of suppliers includes many of the UK's best venues. We are always adding to the locations we offer, but occasionally we may need to withdraw venues featured here for reasons beyond our control. If your chosen location is withdrawn, you will be offered alternative venues wherever possible, but please note this is likely to be at a different location or with a different supplier. Where locations are stated as "UK wide", locations may be limited in remote areas. Each venue has its own terms and conditions (available upon request) and your participation is conditional on your acceptance of these.

Session lengths are approximate, vary from venue to venue and are given simply as an indication of the time you will spend at the venue. Usually your experience will be exclusively timed so that there are not any other people involved. For some experiences, however, where specifically stated, you may be taking turns with other people and there may be waiting time involved. We give itineraries as a guide only and the running order of an event may change.

We welcome the participation of disabled people in our experiences, though we recognise that certain experiences may present difficulties for those with disabilities. We are committed to ensuring that disabled customers are given every opportunity to participate, so we ask that you tell us about any relevant disability at the time of ordering. This enables us to do our best to meet the participant's particular needs. We will be happy to provide information about the disabled facilities available at specific venues on request.

All product description and pricing information displayed on this site before you submit an order with Pure Experiences comprises part of our agreement, ("the Pre-contract Notice"). The Pre-contract Notice contains important information such as a description, price (including VAT) and delivery charges of the good or services ordered. Pure Experience suggests that you print off a hard copy of the product pages if paying by telephone or other notice via paypal or save a copy to your hard drive for your own records.

Pure Experience will not be obliged to supply the goods or services submitted in your order until you have received an e-mail from Pure Experience accepting your order ("Order Confirmation"). However, in the event the goods or services are listed on Pure Experience's site at an incorrect price due to typographical error or error in pricing information received from its suppliers but Pure Experience have accepted your order before the discrepancy is noticed, Pure Experience shall e-mail you to ask whether you are willing to pay the correct price for the goods or services ordered. If you are unwilling to pay the correct price Pure Experience reserves the right to cancel the contract immediately without any liability to you. If Pure Experience exercises its right under clause 3.2 to cancel a contract, it will immediately issue a credit to your debit or credit card account if it has already made a charge to your card before cancelling your order. [In the event that the goods ordered by you are not available Pure Experience reserves the right to provide you with goods of a similar quality and specification and will inform you of such in the Order Confirmation.]

Your personalised gift pack will be sent in plain packaging. We charge Ł3.95 p+p for Royal Mail First Class delivery to a UK address. Packs are normally sent by first class post within two working days of receipt of payment and confirmation of any personalisation. Please allow fourteen days for delivery. Alternatively you can use our courier service. Delivery times quoted are estimates only, and Pure Experience shall not be liable for any delays caused except to the extent caused wilfully or negligently by adultadventures. However, unless we have agreed a longer period for delivery with you, we will either deliver goods and/or services within fourteen days of you placing the order or we will let you know as soon as it will not be possible to meet this obligation. If we do let you know then we will either agree a new time for delivery with you or, at your request, refund any monies paid by you in respect of the delayed goods/services in respect of the "Placing an Order" and "Right to Cancel" sections above.

We can send the gift pack to you, directly to the recipient, or to another address at your request. If your pack goes astray in the post we will provide a duplicate free of charge. Please inform us as soon as possible if you believe this has happened so we can do our best to deliver the duplicate pack in time.

If you need a gift pack urgently, or delivery by a specific date, we recommend our Courier Service. Orders received by 12pm on a working day Monday to Friday can be dispatched the same day. For these next working day deliveries to UK mainland addresses, our non-refundable Courier Service charges are as follows: Delivery on a working day Monday to Friday - Ł15. Orders placed on a Friday before 12pm will be delivered on Monday Orders placed on a Friday after 12pm will be delivered on Tuesday Delivery on a Saturday - Ł25 Our courier will deliver at any time up to 5.30pm. Christmas Last order dates, delivery times, opening hours and courier charges may change over the Christmas and New Year period. Payment for all Pure Experience are to be made prior to provision of goods or services by cheque (made payable to adultadventures) or credit / debit card or PayPal.

You have the right to cancel any contract within seven days from the date Pure Experience sent you the Order Confirmation if adultadventures has contracted to supply services to you, if Pure Experience has not started to provide those services before the expiry of the cancellation period.

We are happy to make refunds on unbooked vouchers, bought direct from adultadventures, within 14 days of purchase. We will make a 10% administration charge (minimum charge Ł25, maximum charge Ł50). Note that refunds are reimbursed to the original orderer, and if originally purchased by credit or debit card, the refund will be credited to the same card. If the card has expired you will need to request a refund in writing, quoting details of a new card.

If the gift pack has been purchased from a retail store, a refund can only be obtained by returning both the gift pack and the unbooked voucher, in good condition, to the place of purchase together with the corresponding till receipt. These refunds will be subject to the store's own terms and conditions.

Cancellation after booking is not possible; however Pure Experience will happily accept a transfer of booking to another recipient or another date. Transfer of booking to another date requires 21 days notice. Depending on specific terms and conditions of individual adultadventure partners, changing a booked date, where possible, amounts to a cancellation, so once your booking has been made you may incur cancellation charges if you have to re-book. Pure Experience does not accept re-bookings or cancellations within 21 days of a booked Pure Experience.

The cancellation notice should be sent by e-mail to Pure Experience at info@pureexcess.co.uk, by post to 22 High Street, Normanton, West Yorks, WF6 2AB, or by fax to 0870 0663583, and must state your name, a description of the goods or services concerned and purchase details. Attaching the Order Confirmation adultadventures originally sent you will also assist Pure Experience in processing your cancellation as quickly as possible. Once Pure Experience has received the cancellation notice according to terms it will send you confirmation by e-mail and will immediately make a refund of the contract price minus charges as above. Cancellations will not be accepted unless you can prove confirmed receipt of the cancellation notice.

All Pure Experience are subject to minimum age requirements - 18 years. We will confirm with you at the time of booking if any restrictions apply to the participant. Once booked, you may be liable for charges if you have to cancel because the minimum requirements are not met. Full details are included in your gift pack and we recommend you read this carefully as soon as you receive it.

All Pure Experience gift packs contain a voucher which is evidence of a payment for a given adultadventure. Except as specified herein payment is non-refundable. Each voucher will show a voucher reference/security code, which must be quoted when dealing with adultadventures and which will be used to identify your payment. Vouchers and the associated references must be kept safely and securely. Pure Experience will take no responsibility for any loss you may incur as a result of impersonation or identity fraud.

The voucher expiry date will be detailed in your gift pack and will be a minimum of ten months from date of purchase. Bookings for dates must be made direct with adultadventures before voucher expiry or the voucher will cease to be valid. No extensions of voucher expiry date are allowed. If purchased from a third-party retailer, voucer expiry dates can be extended to up to 10 months from date of purchase, if presented with a proof of purchase. Contact Pure Experience directly, not the retailer, to enquire.

Specific Pure Experience Gift Packs - Packs valid for a specific adultadventure may, at the sole discretion of adultadventures, prior to booking, be exchanged for another adultadventure. If such exchange is made, no administration charge will be levied. If your chosen experience is higher in price than the amount originally paid you will only be charged the difference. If your chosen experience is lower in price than the original amount, the balance will be held in credit for you to use against any future purchase. Your new experience , and any remaining credit, will have the same expiry date as the original voucher and is non-refundable.

Gift Certificates - Gift certificates may be purchased in differing values. One gift certificate to be used per Pure Experience only.

Certain Pure Experience will have specific terms and conditions that will be based on the type of Pure Experience booked as well as those terms and conditions set by individual Pure Experience partners. These specific terms and conditions form part of the overall terms and conditions of business as listed here and can be found in each gift pack.

In particular, we do ask that all customers respect the photographers and film makers and their studios; and their individual rules and boundaries. Whilst we do accept that a drop or two of Dutch courage may be required, our providers will not tolerate intoxicated behaviour (drink or drugs) or illegal behaviour. Photographers and film-makers have the right to terminate a session at any time for such reasons; no refunds will be given.

If you would like to know what the individual terms and conditions are for a specific Pure Experience prior to booking, please contact us on 0870 0663583. Once booked, you may be liable for charges if you cancel, or are cancelled due to refusal to comply with individual terms and conditions. Booking and attendance signify acceptance of all related terms and conditions, both general and specific.

In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.

All our Pure Experience are offered subject to availability. The most recent information on dates when an Pure Experience is available can be obtained by calling adultadventures on 0870 0663583. We will do our best to secure your preferred choice of dates. To help us, please book as early as possible and, in any event, at least 21 days in advance and further for peak dates such as weekends or holiday periods. Bookings are not confirmed until you receive confirmation in writing from us. For some Pure Experience we may ask you to return the original voucher to us before we can confirm your booking. You should not make any arrangements in connection with the Pure Experience until you have received your booking confirmation.

Where specific elements of the Pure Experience are not available due to mechanical breakdown or illness, we reserve the right to make reasonable substitutions on the day. If this is not possible we reserve the right to cancel the Pure Experience at short notice. We will do our best to notify you as soon as possible and do everything we can to offer you an alternative date or time. We regret that, in these circumstances, Pure Experience is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled Pure Experience.

*Box contents may change from time to time depending upon availability - we may substitute items for products of equal or higher value and quality (without affecting the price).

Pure Experience shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, flood, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other competent authorities.

We welcome your feedback on all of our Pure Experience. If you have a problem or complaint on the day, please bring it to the attention of the host or Pure Experience manager at the venue as soon as possible so they have a chance to put matters right. In general, we consider it unreasonable if you take no action during an event, but then write a letter of complaint at a later date.

Nothing in this Agreement shall affect the statutory rights of any consumer, exclude, or restrict any liability for death or personal injury arising from the negligence or fraud of adultadventures. Subject to clauses above, you agree that Pure Experience shall not be liable either in contract, tort, negligence, statutory duty or otherwise, for any: loss of profits, revenue or goodwill or any type of consequential, indirect or special loss or damage whatever arising from or in any way connected with this Agreement; direct loss or damage (including loss or damage which is reasonably foreseeable or occurs naturally in the course of things) resulting from any acts, omissions, failures or delays occurring on or in relation to those parts of the Internet not under Pure Experience's direct control including, without limitation, damage for loss of business, loss of sales, non payment of sums due, loss of profits, business interruption, loss of reputation, loss of business information, or any other pecuniary loss (even where Pure Experience has been advised of the possibility of such loss or damage).

You also agree that (except in relation to such liability as has been expressly excluded in clauses above) the maximum aggregate of liability of Pure Experience in contract, tort, negligence, statutory duty or otherwise (even where Pure Experience has been advised of the possibility of such loss or damage), for any loss or damage whatever arising from or in any way connected with: any defect in a product; any failure by Pure Experience to process signals, data, information, orders or messages correctly or in a timely manner; any misrouting or non-delivery of signals, data information, messages or orders from you to other persons or from other persons to you, or any scrambling or distortion of data or information contained in them; and any liability not excluded by this Agreement shall, in respect of any one or more events or series or events (whether connected or unconnected) taking place within any twelve month period be limited, in the case of defects falling within clauses above, to three times the price of the relevant goods/services. This limit shall also apply in the event that any exclusion or other provision contained in this Agreement is held to be invalid for any reason and Pure Experience becomes liable for loss or damage that could otherwise have been limited.

Whilst we take every care in choosing our Pure Experience suppliers, inclusion of an aexperience in our range does not mean that we guarantee the safety standards or satisfactory performance of any of the Pure Experience suppliers. Pure Experience's liability for any claim of breach of obligation regarding any single voucher or adultadventure shall not exceed three times the price of that Pure Experience. This excludes claims arising from personal injury or death due to the negligence of Pure Experience or anyone for whom Pure Experienceis responsible.

You agree and acknowledge that you are in a better position than Pure Experienceto foresee and evaluate any potential damage or loss that you may suffer in connection with the goods and services provided by adultadventures, and therefore that Pure Experience cannot adequately insure in respect of such liability. You warrant to adultadventures that you will insure against, or bear yourself, any loss for which Pure Experience has excluded liability.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations of liability set out in this clause may not apply to you.

We endeavour to ensure that the information on this site is accurate and complete. However, the information is published 'as is' without any warranty. We do not accept any liability arising from any error, omission or inaccuracy of content or transmission. We cannot be held liable for any damages arising from the use of this site. adultadventures may publish opinions and third party information and as such accept no liability whatsoever for any reliance placed on such opinions or information.

This website is for information purposes only. This information is not intended for use without professional advice. Save to the extent that it falls within the provisions of clauses above, you shall indemnify Pure Experience and any third party (including its sub-contractors) from and against any liability, losses, rights, expenses, loss of profits, business interruption, consequential loss, pecuniary loss, claims or legal proceedings, including, but not limited to claims involving defamation and intellectual property infringement, and expenses, including legal fees, arising from your use of the adultadventures site or purchase of goods and/or services from that site which are brought or threatened against Pure Experience or suffered or incurred by Pure Experience by another person or entity.

In the event of conflict or inconsistency between the terms of the English language version of this Agreement and any translation provided by us, the English language version shall prevail.

In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.

This Agreement, together with our Privacy Policy, contains the entire agreement and understanding between the parties relating to its subject matter, and (in relation to that subject matter) supersedes any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. Accordingly, we exclude all representations and warranties relating to the subject matter of this Agreement, whether they are statutory or otherwise, as far as is possible by law. In the event of conflict or inconsistency between the above documents, the following order of priority shall apply: (1) this Agreement (2) the Privacy Policy.

On this site you will be offered links to other sites. Pure Experience does not accept any responsibility for these sites, the owners of which do not necessarily have any link, commercial or otherwise, with Pure Experience. Specifically, we can have no liability for their content or privacy policies.

Pure Experience is a trade mark. We have acquired unregistered rights in our trade marks and our logos. No-one may use our trade marks without our express written permission. Neither the purchaser nor the recipient of an Pure Experience is entitled to use any Pure Experience trade marks or logos. The text, illustrations and images used in all Pure Experience promotional literature are protected by copyright and must not be copied in whole or in part without the express permission of Pure Experience.

All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser. Pure Experience reserves the right to change these terms from time to time without reference to customers. These terms and conditions do not affect your statutory rights as a consumer.
